End-user license agreement

This agreement is between Jeroen Reinink, the Netherlands ("we") and the organization that installs or uses the Merge Conflict Resolver extension ("you"). By installing or using the extension you accept this agreement. If you accept on behalf of an organization, you confirm that you may bind that organization.
1. License
We grant you a non-exclusive, non-transferable license to use the extension in your Azure DevOps organization(s):
- Free plan and trial: free of charge, within the limits shown in the extension (currently 10 pull requests per organization per month after a 14-day Pro trial).
- Pro: for one Azure DevOps organization per license key, for any number of its users, for as long as the subscription is paid.
2. Restrictions
You may not circumvent, disable or tamper with the license checks, share one Pro license across multiple organizations, resell or sublicense the extension, or reverse engineer it except where the law expressly allows this.
3. Subscriptions and payment
Pro is sold as a monthly or yearly subscription through Lemon Squeezy, which is the reseller and Merchant of Record and whose terms apply to the purchase. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the paid period. We may change prices for future periods with at least 30 days' notice by email. If Pro doesn't work for you, you can get a full refund by emailing us within 14 days of your first payment.
4. Your data and code
The extension processes your repository content only inside your browser and your Azure DevOps organization. You remain the owner of your code and data. See the privacy policy.
5. Ownership
The extension, including its code, design and documentation, is and remains our property. This agreement does not transfer any intellectual property rights to you.
6. Updates and support
We may update the extension, for example to fix bugs, follow changes in Azure DevOps or add features. Support is provided as described in the support policy.
7. Warranty
We build the extension with care, but it is provided "as is". You are responsible for reviewing merge results before completing a pull request. To the extent permitted by law, we give no warranty that the extension is error-free or fit for a particular purpose.
8. Liability
To the extent permitted by law, our total liability under this agreement is limited to the amount you paid for the extension in the 12 months before the event that caused the damage. We are not liable for indirect or consequential damage, such as lost profits or lost data. These limitations do not apply to damage caused by our intent or gross negligence.
9. Termination
You can stop using the extension at any time by uninstalling it. We may terminate a license if you materially breach this agreement. On termination, sections 5, 7, 8 and 10 remain in effect.
10. Governing law
Dutch law applies to this agreement. Disputes are submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
